Going on top of the Nether

This is definitely a good idea to not allow.

It helps keep the world size in check, and the new region file generation is absolutely a huge lag cause.

I've seen TPS rates in Spigot drop from 20.0 to 15-14 just from 1 player traveling on the roof of the nether.

I can only imagine it being much more evident on a pure vanilla server.

There is, but there are ways to get on it. (but don't try it on the server  )

My only question is when you kick them, the are already still on top of the nether? So really no warning .

The kick is the warning.

It's an easy trick you can do in at least 2 diff ways.
I won't say it here to avoid people from doing it on our server but you can find lots of those on youtube or other sites.

How about just make speed potions bannable on top of the nether?

It's harder to regulate that though. And the amount of damage being on top of the nether causes is just insane. So it makes more sense to not allow it at all.
